Reports: No Charges to Be Filed Against Police Who Shot and Killed Derrick Jones

Both KCBS and the Oakland Tribune are reporting that Alameda D.A. Nancy O'Malley will not press charges against the two police officers who shot and killed Derrick Jones last November.

The KCBS report says Jones' mother, Nellie Jones, said O’Malley told her Tuesday that not enough evidence existed to charge officers Eriberto Perez-Angeles and Omar Daza-Quiroz.

“She said ‘not at this time;’ they need more evidence,” Jones is quoted as saying.

The Tribune attributed its story to anonymous sources.

Jones was an unarmed 37-year-old East Oakland barber shot after a brief chase by police officers, who were responding to a domestic disturbance call. From Oakland North, Nov 9:

Jones took off running, Oakland Deputy Police Chief Jeff Israel said at a press conference Tuesday afternoon. Jones did not respond to commands to halt, Israel said, and instead kept reaching for his waistband. At one point, he said, an officer saw an unspecified metal object in Jones’ hands before he looked over his shoulder toward the officers. The two officers then fired on Jones, Israel said, striking him multiple times. Jones was pronounced dead at the scene, and was unarmed but carrying a metal object, which Israel declined to identify. (Note: The object was later identified as an electronic scale.)

But friends and relatives of Jones challenged the Oakland Police version of the shooting, declaring that the barber was a family man who had been shot at least six times in the back.

The incident became the focus of community protests and has been likened to the shooting death of an unarmed Oscar Grant by former BART police officer Johannes Mehserle.
